Terms of Use

1. General

These Terms govern the use of the DriveTeam mobile application, the website driveteam.com.ua and the driver web cabinet (the "Service"). The Service is owned and operated by Individual Entrepreneur Vadym Biletskyi, taxpayer number (RNOKPP) 2928424215, 25 Livoberezhna St., Skvyra, Bila Tserkva district, Kyiv region, 09001, Ukraine (the "Lessor").

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is

The Service allows fleet drivers to book working shifts, locate a vehicle on a map, get access to a vehicle, and see charges for their shifts and settlements with the fleet. Vehicles are rented to drivers under an agreement with the Lessor.

The Service is a software platform for fleet management. Vehicles are connected to the Service by their owners. The Service is not a taxi service, it does not accept passenger orders and it does not carry passengers.

3. Eligibility

Adults holding a valid driving licence of the appropriate category.
Persons who have passed our checks and entered into an agreement with the Lessor.
Service personnel (car wash, maintenance) — within the scope of access granted to them.

4. Your account

You are responsible for keeping your account and device secure. Accounts are personal and must not be transferred to anyone else. Notify the Lessor immediately if your phone is lost or you suspect unauthorised access.

5. Vehicle access

Access to a vehicle is granted via a driver invitation in Tesla; you use the Tesla app to operate the vehicle.
Tesla access technically remains between shifts and is revoked when the agreement ends. Using the vehicle outside your own shift is prohibited.
Commands you send through the DriveTeam app are verified by the server on every command; the app does not store permissions locally.
The Lessor may suspend or revoke access at any time, including for breach of these Terms, the agreement, or traffic regulations.
You must not let another person drive the vehicle, take it outside the permitted area, or use it for purposes not covered by the agreement.
You must photograph the condition of the vehicle when accepting and handing over a shift.

6. Prohibited conduct

Interfering with the Service, circumventing access controls, or reverse-engineering the application.
Spoofing your device location or supplying false information to the Service.
Attempting to access a vehicle outside your shift.
Using the Service for any unlawful activity.

Breach of this section is grounds for immediate termination of access.

7. Telemetry and monitoring

During a shift the Service collects vehicle telemetry and location data — from the vehicle, the fleet phone installed in the vehicle and the fleet account in the ride-hailing platform. This is necessary to calculate the shift and protect our property. The scope of data, retention periods and your rights are described in the Privacy Policy. Charges for your shifts are available to you in the app.

8. Settlements

Drivers receive fares from passengers and the platform themselves. How the driver pays the revenue share, energy cost and other amounts is governed by the agreement between you and the Lessor; charges are recorded on the driver account in the app. The shift plan is calculated as the fleet's share of fares, excluding energy. The Service displays settlements but does not replace the agreement. In case of conflict, the agreement prevails.

9. Availability

We aim for uninterrupted operation but do not guarantee it. The Service depends on mobile connectivity, satellite navigation and Tesla services, any of which may be unavailable. The Lessor is not liable for inability to use the Service caused by such circumstances.

If phone access to the vehicle is unavailable, contact the fleet operator. Do not attempt to gain access by other means.

10. Liability

The Lessor is not liable for indirect losses, lost profit or data loss arising from use of, or inability to use, the Service, except where such liability cannot be limited under the laws of Ukraine. Liability for traffic offences, vehicle damage and other acts during a shift is determined by the agreement and by law.

11. Intellectual property

The application, website, the DriveTeam name and their contents belong to the Lessor. Use without written permission is prohibited.

12. Independence from Tesla

DriveTeam is a service by Individual Entrepreneur Vadym Biletskyi: we build a fleet management platform for electric vehicles and operate on it ourselves. DriveTeam is not affiliated with Tesla, Inc. Tesla is a registered trademark of Tesla, Inc.

13. Changes to these Terms

We notify users of material changes in the app and by email at least 14 days before they take effect.
